Terms of Use

1. Who we are

Calmer Home is operated by Abhishek Gawde (see Impressum). These Terms govern your use of calmerhome.app ("the website") and the Calmer Home iOS app ("the app"). By installing or using the app, or by using the website, you agree to these Terms. If you do not agree, do not install the app and do not use the website.

2. Age restriction

You must be at least 16 years old to use the app, or the minimum age for digital services in your country of residence (13 in the United States with verifiable parental consent). The app is not directed at children under 13, and we do not knowingly collect data from anyone under 13.

3. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use the app on Apple devices you own or control, solely for personal, non-commercial household-organization use. All intellectual property rights in the app and the website remain with us.

4. Acceptable use

You agree not to:

• reverse-engineer, decompile, or disassemble the app, except where Apple's standard user rights or applicable law expressly allow;
• distribute, sublicense, or resell the app or any portion of it;
• circumvent any technical measures that enforce the one-time purchase or feature gates;
• use the app in violation of applicable laws or sanctions regimes (including OFAC and EU restrictive measures);
• submit third-party personal data into the app without that person's consent.

5. Payments, refunds, and Apple

The app is sold as a one-time purchase through Apple's App Store. All payments, billing questions, and refund requests are handled by Apple under Apple's own terms. You can request a refund from Apple at reportaproblem.apple.com. We are not able to process refunds directly.

6. Right of withdrawal (EU/EEA)

If you are a consumer in the EU or EEA, you have a 14-day right of withdrawal for digital content under Directive 2011/83/EU. By confirming your purchase in the App Store, you expressly request that performance begins immediately and you acknowledge that you lose your 14-day right of withdrawal once the premium content has been unlocked on your device.

7. Your data and backups

The app stores your data locally on your device. We operate no servers that hold your rooms, tasks, household members, or progress. You are responsible for maintaining backups of your device, for example via iCloud device backup. If you reset, lose, or replace your device without a backup, your app data cannot be recovered by us. 8. Disclaimer of warranties

The app and the website are provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Mandatory consumer-protection rights granted to you by the law of your country of residence are unaffected.

9. Limitation of liability

To the maximum extent permitted by law, our total aggregate liability to you arising out of or in connection with the app is limited to the amount you paid for the app in the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect, incidental, consequential, or special damages, including lost time, lost data, or emotional distress. Nothing in these Terms excludes or limits liability for damages that cannot, under applicable law, be excluded or limited (including liability for gross negligence or wilful misconduct).

10. Indemnification

You agree to defend, indemnify, and hold harmless the operator from any third-party claim arising out of your violation of these Terms or your misuse of the app, except to the extent the claim results from the operator's own willful misconduct or gross negligence.

11. Termination

You may stop using the app at any time by deleting it. We may suspend or terminate your access if you materially violate these Terms. Termination does not entitle you to a refund; see §5 for Apple's refund process.

12. Changes to these Terms

We may update these Terms when the app, website, or legal requirements change. The current version is always available on this page. Material changes will be signaled through the app's release notes or the website.

13. Governing law

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer resident in the EU/EEA, the mandatory consumer-protection rules of your country of residence remain unaffected. Exclusive place of jurisdiction for disputes with merchants is the competent court at the operator's registered seat.
